Some hopeful news. Congress is taking the Supreme Court's decision to threaten private property seriously and is considering passing legislation to ban federal dollars from going to projects that invoke eminent domain to take property for private use. The House has already passed a bill barring federal transportation dollars from going to such projects. And Chief Justice hopeful, John Roberts has already stated that he believes that the Congress and state legislatures have the power to trump the decision.
For once it appears that the legislature is needed to protect the country from the judiciary. The eminent domain decision was a sad day for the Court.
